Payment Terms & Late Fees

Payment Terms and Late Fees

All invoices are due and payable in full on the due date stated on the invoice.

Any amounts not paid when due may, at Conexwest’s discretion, accrue a finance charge equal to the greater of: (i) $30 per overdue invoice, or (ii) 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by applicable law, whichever is less. Such charges shall be calculated from the due date and continue until the balance is paid in full.

Application of Payments

Payments received may be applied at Conexwest’s discretion first to any accrued late fees, finance charges, collection costs, or other charges, and then to the outstanding principal balance.

Collection Costs

Customer agrees to pay all reasonable costs of collection incurred by Conexwest, to the extent permitted by law, including but not limited to collection agency fees, attorneys’ fees, court costs, and any other expenses associated with enforcing payment.

Suspension of Services

Conexwest reserves the right, without liability, to suspend services, deliveries, rentals, or future orders on any account with past-due balances until such amounts are brought current.

Chargebacks and Disputed Payments

Any chargebacks, payment disputes, or reversals are subject to a processing and administrative fee equal to the greater of $500 or the actual costs incurred by Conexwest.

Indemnification

Purchaser agrees to defend, indemnify, and hold harmless Conexwest, its affiliates, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, demands, actions, costs, and expenses (including attorneys’ fees) arising out of or related to the sale, delivery, use, operation, or disposition of the equipment.
